Thailand Office of Insurance Commission (OIC) has issued guidance to insurers on considering and paying claims arising from reported border tensions and clashes between Thailand and Cambodia, urging companies to quickly survey damage and process compensation. The OIC’s preliminary view is that the incident does not meet the definition of “war” under policy exclusion clauses. Insurers are asked to clarify interpretation of policy terms through discussions with reinsurers and to assess any other relevant exclusions case by case based on the policy wording and facts. Where exclusions apply, firms are encouraged to consider providing ex gratia payments, and the OIC indicated it is ready to act as an intermediary in negotiations to support affected policyholders and the public. The OIC will continue periodic discussions with the Thai Life Assurance Association, the Thai General Insurance Association, the insurance sector and other agencies to monitor the situation and determine further insurance assistance measures.
