Indonesia’s Financial Services Authority (OJK) published an enforcement update underscoring that bank borrowers proven to have committed banking crimes can face criminal sanctions, citing the PT BPR Duta Niaga Pontianak case which has reached a final and binding court decision. The matter originated from OJK supervision and was pursued through a special examination, investigation and prosecution. The borrowers were found to have intentionally caused or assisted members of the board of directors to make false entries in the bank’s books, business activity reports and other documents, including through the receipt of credit facilities that did not comply with requirements. The Pontianak District Court convicted two borrowers, AS and HS, sentencing each to one year’s imprisonment and fines of IDR 250 million and IDR 400 million respectively, while bank officials were also convicted with the president director (ZB) sentenced to four years’ imprisonment and an IDR 600 million fine and the operations director (DD) to three years and six months’ imprisonment and an IDR 600 million fine.
