The Ukraine National Commission on Securities and Stock Market adopted a broad set of supervisory and authorisation decisions spanning depository services, asset management and collective investment vehicles, and approved a procedure for documenting and considering violations of relevant legislation under martial law. The package also includes a pilot project to liquidate a mutual venture non-diversified closed-end investment fund by transferring all its assets and liabilities to a closed-end non-diversified venture corporate investment fund. Among entity-specific actions, steps were taken relating to the termination of FC DEKRA LLC’s depository activities, an appointment to the Management Board of PJSC Settlement Center was approved, and an intention to acquire a significant participation in REACOMP–INVEST LLC was agreed. The Commission issued an institutional investor asset management licence to AMC KIP-AKTIV, agreed amendments to the charter of VPF Privatfond, and cleared the appointment of a Risk Manager and Compliance Manager at AMC BUDCAPITAL CITY LLC and an internal auditor and chief accountant at AMC PATRIOT LLC. It also prohibited changes to the depository accounting system and transactions relating to securities of JSC ZNVCIF BUSINESS GROUP INVEST, and registered collective investment share issues and related prospectuses for JSC ZNVCIF DIANA INVEST, JSC ZNVCIF TAD INVEST and JSC ZNVCIF TRIDENT DEVELOPMENT. On the policy and governance side, a revised NSSMC certificate on draft amendments to the Tax Code and related legislation (reg. No. 13233-1) was approved, along with a draft decision to amend NSSMC Decisions No. 879 and No. 880, and amendments to NSSMC Decision No. 1056. Changes were also made to the criteria for determining enterprises important for the national economy in capital markets and organised commodity markets, a draft Cabinet of Ministers resolution amending Government Resolutions No. 1039 and No. 18 was considered, and a petition for non-application of a business reputation inconsistency marker was granted.
