The National Credit Union Administration (NCUA) announced a third round of proposed regulatory changes under its Deregulation Project and requested comments on four proposals intended to clarify agency guidance and remove unduly burdensome or obsolete requirements. One proposal would remove 12 CFR 701.31 on nondiscrimination requirements, with NCUA no longer summarizing requirements issued by other agencies; NCUA stated this would not change credit unions’ compliance obligations under the Fair Housing Act and Equal Credit Opportunity Act, but should reduce confusion because the provision has not kept pace with current law. Three additional proposals would eliminate Interpretive Ruling and Policy Statement (IRPS) 08-2 on service to underserved areas and IRPS 10-1 on community chartering policies, and rescind IRPS 11-2 on federal corporate credit union chartering, removing standards NCUA characterized as redundant and reducing the number of sources federal credit unions must consult for chartering and field-of-membership compliance; for corporate credit union chartering, the intent is to rely on the Federal Corporate Credit Union Chartering Manual for procedures and timelines. NCUA directed stakeholders to submit comments through the Federal Rulemaking Portal by searching the relevant docket numbers.
