The Thailand Securities and Exchange Commission is consulting on revised application fees for depository receipt offerings to align the fee structure with proposed Shelf Approval and Shelf Filing frameworks. The changes would replace the current collection of both applicable fees for each application with an annual issuer qualification fee and a per-security fee for individual filings. For an initial Shelf Approval application and each annual renewal, issuers would pay THB 50,000 for the assessment of their qualifications and THB 15,000 for each foreign underlying security. Subsequent applications during the annual shelf period would incur only the THB 15,000 fee per foreign underlying security. The proposed framework would allow approved issuers to make unlimited offerings by number or value for one year, subject to continued compliance with issuer qualifications and a project-specific Shelf Filing for each offering.
