Thailand’s Securities and Exchange Commission (SEC) is consulting on eight draft notifications to adapt derivatives business licensing to accommodate digital assets as underlying assets and revise financial reporting standards for derivatives exchanges and clearing houses. The licensing proposals cover exchanges, clearing houses and intermediaries. Digital asset business operators would be able to apply for derivatives business licenses without establishing new companies, following the earlier designation of digital assets as eligible underlying assets under the Derivatives Act of 2003. The licensing changes would facilitate entry without imposing undue burdens, while the financial reporting revisions would strengthen oversight of derivatives market infrastructure. The framework would provide investors with an additional way to hedge portfolio risks through digital asset derivatives traded on regulated exchanges. The drafts develop principles consulted on in April and May 2026, which most stakeholders supported. A separate August consultation addressed conditions for intermediaries facilitating clients’ investment in overseas digital asset derivatives, rather than the licensing framework covered here.
