The Sanctions Commission of France's Autorité des marchés financiers has sanctioned financial investment adviser Kerdiz Finance et Conseil and its former managers, Anthony Finck and Marc Peuvrier, for breaches of professional obligations, imposing a EUR 300,000 penalty on the firm and EUR 75,000 on each manager. The penalties are accompanied by a temporary five-year prohibition on carrying on the activity of financial investment adviser. The decision relates to misconduct between 1 January 2020 and 28 June 2023, including allowing the firm to be presented as an authorised investment services provider despite not having that status and inaccurately claiming to a potential intermediary that it had obtained AMF authorisation to market Vivat Multitalent securities. The Commission also found shortcomings in conflicts of interest arrangements linked to the firm’s commercial and capital ties with the Vivat Multitalent group, failures to apply product governance measures and to collect sufficient information on distributed products, and advice outside the limits of its status, including recommending Multitalent securities to clients despite their marketing being prohibited in France. Additional findings covered a solicitation campaign for the Guyane Agricole offer, deficiencies in anti-money laundering and counter-terrorist financing obligations, and lack of diligence towards inspectors. The decision may be appealed.

The Sanctions Commission of France’s Autorité des marchés financiers has fined financial investment adviser Kerdiz Finance et Conseil EUR 300,000 and its former managers EUR 75,000 each, and imposed a five-year ban on financial investment adviser activity for breaches between 1 January 2020 and 28 June 2023. Misconduct included misrepresenting regulatory status and authorisation, conflicts of interest linked to the Vivat Multitalent group, failures in product governance, client information collection, and AML/CFT controls, as well as advising on prohibited Multitalent securities and lack of diligence towards inspectors.
