The Upper Tribunal has upheld the Financial Conduct Authority’s ban on Crispin Odey from the financial services industry, finding that the founder and majority owner of Odey Asset Management lacked integrity. It fully upheld all five FCA allegations, including that Odey twice dismissed the firm’s executive committee to halt disciplinary proceedings concerning his repeated inappropriate behavior toward female employees. The Tribunal also found that Odey lacked candor in dealings with the firm, its clients, investors and the FCA, including through false assertions and threatening behavior toward FCA staff. It upheld the financial penalty but reduced it from GBP 1.83 million to GBP 1.53 million after rejecting the FCA’s uplift for aggravating factors.
