The Australian Securities & Investments Commission has published an updated Regulatory Guide 168 Product Disclosure Statements: Disclosure and other obligations to clarify disclosure expectations and help industry prepare Product Disclosure Statements that meet Corporations Act 2001 requirements, following consultation with industry. The revised guidance incorporates content from other ASIC publications that have now been withdrawn, adds references to ASIC relief instruments identified by stakeholders as useful, and updates Section D on compliance risks to clarify what occurs if Product Disclosure Statement requirements are not met. Appendix 1 has also been updated to include ASIC’s section 1013DA disclosure guidelines for Product Disclosure Statements that claim labour standards or environmental, social or ethical considerations are taken into account in investment decisions, with references to further relevant ASIC guidance. The withdrawn publications are Information Sheet 94, Information Sheet 155, Regulatory Guide 65, Regulatory Guide 66, Regulatory Guide 197 and Regulatory Guide 219.
