The European Securities and Markets Authority has signed a memorandum of understanding with the Securities and Exchange Board of India on supervisory cooperation and information exchange concerning Indian central counterparties. The agreement meets a requirement for third country CCP recognition under the European Market Infrastructure Regulation, allowing CCPs established in India and supervised by the Securities and Exchange Board of India to reapply for recognition and creating a pathway to restore access for EU clearing members. The nonbinding agreement replaces the parties’ 2017 memorandum to reflect amended European Market Infrastructure Regulation requirements. It covers cooperation on recognition reviews, regulatory and enforcement actions, material changes affecting CCPs and emergency situations, with European Securities and Markets Authority information requests directed through the Indian regulator. Following an earlier agreement with the Reserve Bank of India, the authority is also discussing a similar arrangement with the International Financial Services Centres Authority.
