The Luxembourg Commission de Surveillance du Secteur Financier has introduced new electronic communication means for regulatory requests and reporting and requires the PDAOFI self-assessment questionnaire to be submitted annually in electronic form. The requirement applies to all professional depositaries of assets other than financial instruments (PDAOFI) serving Luxembourg-domiciled undertakings for collective investment under Article 26-1 of the Law of 5 April 1993 on the financial sector, as amended. It replaces the annual “list of information on the depositary function” previously required under Annex 1 of CSSF Circular 18/697. The reference date for the data is 31 December 2024 and submissions must be received by 31 March 2025; the CSSF has published a user guide covering the submission process.
