The Brazilian Superintendence of Private Insurance has launched Public Consultation Notice No. 01/2026, seeking comments on a draft National Council of Private Insurance (CNSP) resolution setting out general characteristics for the operation of risk coverages in personal insurance. The proposal forms part of SUSEP’s 2026 regulatory plan and is intended to update the existing framework in light of Law No. 15.040/2024, which introduced a new legal framework for insurance contracts. SUSEP highlighted improved conceptual definitions as a central element, aimed at facilitating interpretation by policyholders, insurers and the courts and increasing predictability in contracts. After this stage, SUSEP plans to revise SUSEP Circular No. 667/2022 to set complementary rules for operationalising these coverages. The consultation will remain open for 20 calendar days from the publication of the notice and is available through SUSEP’s Public Consultation System on its website.
