The Agency for Regulation and Development of the Financial Market of the Republic of Kazakhstan has reminded the market that an independent insurance ombudsman operates in Kazakhstan to resolve insurance disputes out of court under national law. Individuals and small businesses can bring disputes across all types of insurance if the amount claimed does not exceed 10000 monthly calculation indices, while other legal entities can use the ombudsman only for compulsory motor insurance disputes. The service is free of charge and is intended to settle cases through document review, consultations with the parties and recommendations aimed at restoring policyholders' rights. If an applicant accepts the ombudsman’s decision, the insurance organization must implement it. If the applicant disagrees, the dispute can be taken to court, with the ombudsman’s decision attached as confirmation that the mandatory pre-trial dispute resolution procedure has been completed. Applicants must first notify the insurer of their intention to apply to the ombudsman and wait three working days before filing if the disagreement remains unresolved or no response is received.
