Ireland's Department of Finance has announced the commencement of statutory “Right to Be Forgotten” protections for cancer survivors applying for mortgage protection insurance on their principal private residence. Insurers must disregard an applicant’s cancer history where active treatment ended at least five years ago, the applicant has been in complete remission for at least five years and the cover sought does not exceed EUR 650,000. The legislation strengthens a voluntary industry code introduced in December 2023, which generally required seven years after treatment and covered policies up to EUR 500,000. The statutory framework applies the five-year period regardless of the applicant’s age at diagnosis and requires normal underwriting only for coverage above EUR 650,000. The Department of Finance will monitor implementation across the market.
