The Kuwait Capital Markets Authority (CMA) has submitted a report to the Attorney General alleging that a whistleblower, identified as a listed company, committed offences under Kuwait’s capital markets framework. The CMA links the report to the listed company’s alleged conduct of investment portfolio management without obtaining the required CMA licences and to an assertion made against the CMA that it had taken an action it had not. The referral cites the crime set out in Item (2) of Article 63 of Law No. 7 of 2010 establishing the CMA and regulating securities activities, as amended, which is criminalised under Item (1) of Article 126 of the same law, as well as the crime set out in Article 125.
