The Brazil Securities Commission (CVM) will hold a hearing on Sept. 8 from 3 p.m. in three administrative enforcement proceedings concerning alleged market misconduct, fiduciary and disclosure breaches, and failures by a former investor relations director. Two proceedings relate to Brazil Realty FII. The first examines an alleged fraudulent capital markets transaction connected with the fund’s third issuance of units, along with alleged fiduciary and information duty breaches and obstruction of supervision. The second concerns allegations that Milo Investimentos and Pedro Junqueira Moll created artificial demand, supply or pricing conditions during a transfer of the fund’s units. The third proceeding considers whether Carolina Pestana Coelho, former investor relations director at Ybirá Capital, failed to provide information required to convene an extraordinary general meeting, disclose board meeting minutes and update the company’s reference form within regulatory deadlines.
