The Australian Securities and Investments Commission has disqualified Alan MacDonald from managing corporations for the maximum five-year period following his involvement in the failure of plumbing company Qwik Track Plumbing and security companies All Time Protection and Thanos Protection. The disqualification runs until July 29, 2031. At the time of the decision, the companies owed unsecured creditors a combined AUD 1.18 million, including more than AUD 926,000 to the Australian Taxation Office. ASIC found failures involving tax and lodgement obligations, company records and assistance to liquidators. It also found that MacDonald allowed Qwik Track to incur debts when there were reasonable grounds to suspect insolvency, improperly transferred company vehicles for no consideration and was linked to AUD 456,000 in voidable director-related transactions. Further findings included unexplained withdrawals from All Time Protection and illegal phoenix activity involving the transfer of Qwik Track’s business while leaving substantial tax debt behind. MacDonald may seek review by the Administrative Review Tribunal.

The companies owed unsecured creditors AUD 1.18 million, while ASIC’s findings included tax and record-keeping failures, suspected insolvent trading, misuse of company assets and illegal phoenix activity.
