The European Banking Authority published final draft Regulatory Technical Standards to strengthen cooperation and information exchange among competent authorities supervising third-country branches in the EU, including practical arrangements for organising colleges of supervisors. The standards, tailored to third-country branches and applying proportionality, cover two areas. For class 1 third-country branches, they set out how supervisory colleges should be established and operate, including coordination of supervisory activities in both normal and emergency situations, and include an annex mapping template to help determine when a college is required under the Capital Requirements Directive. For other third-country branches where a college is not needed, they specify how authorities should cooperate and exchange information to support supervision in going concern and emergency situations. The RTS were developed under Article 48p(7) of Directive 2013/36/EU and form part of phase 2 of the EBA roadmap for implementing EU Banking Package market access mandates following the new branch regime introduced by Directive (EU) 2024/1619.
