The Guernsey Financial Services Commission has made four new appointments to its panel of Senior Decision Makers, who determine the outcomes of the Commission’s enforcement cases, including contested cases involving findings of serious regulatory shortcomings against licensees and or individual directors. Senior Decision Makers sit alone to hear such cases and determine penalties, including the level of any financial penalty, any period of prohibition from practising in the industry, and the contents of any public statement issued by the Commission. The new appointees are Mr Raymond Cox KC, Mr Jonathan Kinnear KC, Mr Thomas Munby KC and Mr Andrew Webster KC, taking the panel chaired by Ms Leigh-Ann Mulcahy KC to 12 members. The Commission indicated the expansion is intended to increase the likelihood of Senior Decision Maker availability and support timely case outcomes, rather than reflecting increased enforcement activity, noting that the number of ongoing cases has reduced slightly in recent years.
