The Central Bank of Ireland has published supplemental guidance on prohibition notices under the Fitness and Probity Regime. The guidance sets out the circumstances a decision maker will consider when determining the nature, scope and duration of a measure barring a person from performing a controlled function at a regulated financial firm. Following consultation, the Central Bank made targeted amendments addressing factors relevant to prohibition decisions and the publication of notices. The guidance supplements the main guidance on fitness and probity investigations, suspensions and prohibitions, which is under review and will eventually be integrated with the new document as part of wider changes responding to a recent High Court judgment on enforcement procedures.
