The South Africa Financial Sector Conduct Authority (FSCA) has appointed a curator, by agreement with Johannes Lodewicus Du Plessis and JLD Investments CC and without court intervention, for part of their financial services business under section 5(10) of the Financial Institutions (Protection of Funds) Act. The curatorship forms part of an FSCA investigation triggered by information that Du Plessis collected funds from the public to trade in equities and allegedly promised unrealistic returns. Aubrey Magerman of Magerman Attorneys was appointed as curator, with the stated objective of protecting the interests of clients who invested with Du Plessis and JLD Investments. The curator’s powers are subject to FSCA control under section 5(6) of the Act and the curator must provide the FSCA with written monthly updates on the progress of the curatorship. The FSCA’s investigation remains ongoing and no findings have been finalised.
