The Brazilian Superintendence of Private Insurance (SUSEP), represented by Director Jéssica Bastos, discussed ongoing studies to update Brazil’s secondary insurance regulatory framework in response to Law 15.040 in an AIDA CAST podcast hosted by AIDA Brasil. The discussion covered key impacts of Law 15.040 and initiatives under analysis, including the application of Article 97 and potential changes affecting claims handling, limitation periods and authorisations. Bastos also indicated that regulation for large risks will receive differentiated treatment that may not follow the model of CNSP Resolution No. 407/2021, while keeping contractual freedom as a central principle. SUSEP signalled that it plans to continue engaging with the market to clarify questions arising from the law, including through public consultations, meetings and events.
