The Commodity Futures Trading Commission and Securities and Exchange Commission have issued a joint request for comment on whether certain derivatives product definitions and interpretive frameworks should be updated, clarified or better aligned. The review covers how current definitions, interpretations and jurisdictional boundaries apply to changing market structures, financial products and trading practices. The request asks for input on definitions of swaps and security-based swaps, including the scope of some exclusions from the swap definition, as well as the treatment of mixed swaps and novel or emerging products. It also targets broader jurisdictional and interpretive questions, areas where regulatory definitional lines need greater clarity and possible areas for alternative compliance. The comment period will remain open for 60 days after the request is published in the Federal Register.
