The Australian Securities and Investments Commission reported that former FAL Healthy Beverages CEO and director Tim Xenos was resentenced to six months’ imprisonment, to be served through an intensive corrections order, with 80 hours of community service. The remaining convictions concern making business decisions while disqualified from managing a corporation and failing to fully and truthfully disclose information to his bankruptcy trustee. The resentencing followed the District Court of New South Wales’ decision in April 2026 to acquit Xenos of dishonestly using his position with the intention of gaining an advantage for himself. The court found the remaining offenses were serious and that imprisonment was the only appropriate sentence. The Commonwealth Director of Public Prosecutions prosecuted the case following an ASIC investigation and referral.
