The Thailand Securities and Exchange Commission has opened a public consultation to assess the effectiveness of the Emergency Decree on Special Purpose Juristic Persons for Securitization B.E. 2540 (1997) and related regulations. The review is intended to determine whether the framework remains appropriate under current conditions and whether changes are needed to support securitization transactions as an alternative funding channel. The consultation follows the requirement under the Act on Legislative Drafting and Evaluation of Laws B.E. 2562 (2019) for state agencies to evaluate laws at least every five years. The SEC is seeking feedback on issues and obstacles in the decree and related rules, including questions around enforcement, the continuing necessity of the law, and its consistency with current circumstances. The feedback will inform any decision on revising the framework to promote securitization without imposing undue burdens on the private sector while maintaining investor protection. The public hearing runs until 16 July 2026.
