The Brazil Securities Commission (CVM) issued a market alert and, through Declaratory Act CVM 23,511, ordered Elion Capital Ltda to immediately halt any public offering of securities intermediation services after indications were identified that the firm and its partners were targeting Brazil-resident clients for securities transactions while presenting themselves as investment advisers. The alert applies to Elion Capital Ltda and its partners Aluisio Sebastião da Rosa, Gleison Nunes Dias, Saulo Dutra Oliveira and Johan Philipe Ribeiro Muniz, associated with the websites elioncapital.com.br and elibank.com.br. CVM stated they are not authorised to intermediate securities, act as an investment adviser, or raise investor funds for investment in securities, and noted that even if investment advisory authorisation existed, it would not permit the type of fundraising identified, which involved deposits into Elion Capital’s corporate account.
