The Brazilian Superintendence of Private Insurance (SUSEP) has reminded entities that associations carrying out mutual property protection must complete mandatory registration by 15 July 2025 if they were operating when Complementary Law No. 213/2025 was published and want to continue in the sector. More than 600 associations have already registered since the system became available in April 2025, under SUSEP Resolution No. 49/2025. Registration requires amending the association’s bylaws or articles to meet the new legal requirements, but where completion of the notarial/registry filing is delayed for reasons attributable to the registry office, SUSEP will accept registration within the legal deadline based on submission of the assembly-approved statute, the assembly minutes and the filing protocol, with the expectation that the registration record is updated later with the registered statute. SUSEP also clarified that only associations may provide mutual property protection and form groups for that purpose; cooperatives and other non-association entities must first convert into a properly constituted association to register, and entities that do not regularise must cease these activities or face potential liability.
