The Philippine Securities and Exchange Commission has detailed electronic submission procedures for the Money Laundering and Terrorist Financing Prevention Program (MTPP), reinforcing existing requirements for securities intermediaries, investment and fund businesses, real estate investment trust fund managers, and lending and financing companies. Covered persons that have not yet filed must submit the MTPP using the company’s official email address and attach evidence that the board, or the appropriate head of a foreign firm’s local branch, approved the program. Hard copies are not required. Covered persons applying for registration or a secondary license may submit a sworn certification at the application stage confirming that the MTPP has been prepared, noted and approved. Once approved, they must file the MTPP within 10 days after receiving their certificate of registration or secondary license. Noncompliance may result in penalties under the SEC’s 2018 anti-money laundering and counter-terrorist financing guidelines and the implementing rules of the Anti-Money Laundering Act.
