The Luxembourg Commission de Surveillance du Secteur Financier (CSSF) has issued Circular CSSF 25/894, repealing and replacing Circular CSSF 15/612, to update the information Luxembourg-established investment fund managers (IFMs) must submit to the CSSF on investment funds that are not authorised by the CSSF. The new circular broadens the scope to all CSSF non-authorised funds managed by a Luxembourg IFM, and requires IFMs to notify the CSSF of their management of European UCITS and European AIFs via a dedicated eDesk procedure. In principle, these notifications should be made before the notifications related to use of the European management passport under the freedom to provide services or freedom of establishment. The required dataset is also expanded, with IFMs expected, where applicable, to provide additional details on the notified fund’s service providers beyond those already captured in the existing form.
