The U.S. Securities and Exchange Commission filed fraud charges against former Tricolor Holdings CEO Daniel Chu, CFO Jerome Kollar and Senior Director of Finance Ameryn Seibold over an alleged multiyear scheme involving subprime auto loan-backed securities. The SEC alleges that, from at least 2020 until Tricolor’s September 2025 bankruptcy, the defendants double pledged hundreds of millions of dollars of auto loans across securitizations and warehouse lending facilities while misrepresenting the eligibility and performance of the collateral and Tricolor’s financial condition. Tricolor raised more than USD 1.9 billion through asset-backed securities offerings, with approximately USD 945 million in principal still outstanding at bankruptcy. The complaint alleges that the defendants disguised delinquent, defaulted and fictitious loans as current, contributing to an estimated USD 800 million collateral shortfall. The SEC seeks injunctions, disgorgement with prejudgment interest and civil penalties against all three defendants, as well as officer and director bars against Chu and Kollar.
