The European Banking Authority has repealed its Guidelines specifying the types of exposures to be associated with “high risk exposures”, citing the application of the new Capital Requirements Regulation (CRR 3) and aiming to provide legal certainty to the market. The Guidelines, first published on 15 March 2019 under Article 128 of the CRR, clarified which exposures should be treated as high risk exposures. Under CRR 3 this exposure class no longer exists, with Article 128 now referring only to “subordinated debt exposures”, making the Guidelines no longer applicable.
