The Commodity Futures Trading Commission’s Market Participants Division issued a no-action position broadly covering providers of passive software, extending relief similar to that provided in Staff Letter 26-09. Subject to specified conditions, the division will not recommend enforcement action against eligible providers or relevant personnel for failing to register as an introducing broker or an associated person of an introducing broker. The relief applies only to the provision and marketing of software that enables users to trade with registered futures commission merchants, introducing brokers and designated contract markets.

Commodity Futures Trading Commission broadens no-action relief for passive software providers
The Commodity Futures Trading Commission broadened no-action relief for providers of passive software. Subject to specified conditions, eligible providers and personnel will not face recommended enforcement action for introducing broker registration failures related solely to software facilitating user trading with registered intermediaries and markets.
