The Luxembourg Financial Sector Supervisory Commission (CSSF) has drawn the attention of approved statutory auditors and approved audit firms to a new audit-report statement required under Luxembourg law implementing EU rules on disclosure of income tax information by certain undertakings and branches. Where a Luxembourg-law undertaking’s financial statements are subject to a statutory audit, the audit report must state whether the undertaking was required to publish a report on income tax information for the preceding financial year and, if so, whether it was published in line with the applicable publication requirements. The requirement stems from Article 72s exdecies of the amended Law of 19 December 2002 following the Law of 15 August 2023 transposing Directive (EU) 2021/2101 and amending, among other texts, the Law of 10 August 1915 on commercial companies. It applies from the start of the first financial year beginning on or after 22 June 2024.

The Luxembourg Financial Sector Supervisory Commission (CSSF) has mandated that audit reports for Luxembourg-law undertakings include a statement on the requirement and compliance of publishing income tax information, as per EU rules. This requirement, effective from financial years starting on or after 22 June 2024, follows amendments to the Law of 19 December 2002 and the Law of 10 August 1915.
