The Brazilian Superintendence of Private Insurance has opened a public consultation on a draft resolution that would standardise how information must be submitted to, and disclosed by, SUSEP on disputes under insurance contracts that are resolved through alternative dispute resolution methods, as required by Law No. 15.040/2024. The proposal would require the obligation to disclose to be expressly set out in the dispute resolution arrangement, such as an arbitration clause, arbitration submission agreement, or equivalent documentation. The chamber administering the procedure would have to submit the required information electronically to SUSEP within 30 days of the dispute being resolved, and SUSEP would publish it in a dedicated repository on its website within 30 days of receipt. Submissions must not include any data that could identify the parties or any confidential or privileged content, while insurers and single insurance cooperatives would be responsible for monitoring compliance with the submission obligation until it is fulfilled; breaches would be subject to applicable sanctions. Comments can be submitted within 15 calendar days from publication of the consultation notice via SUSEP’s Public Consultations System.
