The Argentina Securities Commission (CNV) issued Interpretative Criterion No. 97 clarifying what corporate charter provisions companies must have to register in the Virtual Asset Service Providers (PSAV) Register, including for companies already registered under General Resolution No. 994. Under the CNV rules, applicants must file their current charter showing the relevant service activity. For Argentina-incorporated companies, the corporate purpose must expressly state that the company will act as a PSAV, and generic or ambiguous wording will not be accepted. For foreign-incorporated companies, the CNV may accept that the parent company’s corporate purpose covers PSAV activities expressly or implicitly, provided this aligns with the law of the home jurisdiction and with the activities to be carried out by the Argentine branch or representation. The current charter must also be published on the AIF as a consolidated text duly registered with the Public Registry of Commerce.
