The European Securities and Markets Authority has published or updated Questions and Answers under the European Market Infrastructure Regulation (EMIR) and the Markets in Crypto-Assets Regulation (MiCA), providing additional supervisory guidance for reporting and crypto-asset market practices. Under EMIR, the updated Q&A addresses how to notify errors and omissions for exchange-traded derivatives where multiple Entities Responsible for Reporting are involved and are managed by the same management company or alternative investment fund manager. Under MiCA, ESMA added guidance on how to distinguish between different execution services and clarified offerors’ and crypto-asset service providers’ responsibilities regarding white papers for Title II tokens that were admitted to trading prior to 30 December 2024.
