The National Credit Union Administration, together with the Department of Housing and Urban Development, Consumer Financial Protection Bureau, Department of Justice, Federal Deposit Insurance Corporation, Office of the Comptroller of the Currency and Federal Housing Finance Agency, has rescinded the 2022 interagency statement on special purpose credit programs under the Equal Credit Opportunity Act and Regulation B. Creditors should no longer rely on that statement, previous guidance or related issuances. The agencies framed the rescission as reinforcing equal treatment and prohibitions on discrimination based on protected characteristics. The Department of Housing and Urban Development and Department of Justice emphasized that residential real estate and credit decisions must not favor or disadvantage applicants based on race or other protected characteristics.
