The Australian Securities & Investments Commission has made a new legislative instrument that remakes and consolidates three financial advice-related relief instruments that were due to sunset on 1 October 2025, maintaining the existing relief in a single instrument. The ASIC Corporations (Financial Services Guide, General Advice Warning and Advertising Related Relief) Instrument 2025/234 continues the relief previously provided under ASIC Corporations (Advertising by Product Issuers) Instrument 2015/539, ASIC Corporations (General Advice Warning) Instrument 2015/540 and ASIC Corporations (Financial Services Guides) Instrument 2015/541. Following ASIC’s 15 May 2025 consultation with feedback requested by 12 June 2025, five formal submissions supported extending the relief and consolidating the three instruments; feedback on the limitations of general advice and requests to incorporate the relief into primary law or make minor modifications were shared with Treasury. The remake aligns with the Legislation Act 2003 sunsetting framework for legislative instruments.
