The Australian Securities and Investments Commission reported that former financial services company director and financial adviser Donald Cuthbertson pleaded not guilty in the Federal Court of Australia to 24 offences. The indictment includes 10 counts of making false or misleading statements, 12 counts of dishonest conduct and two counts of attempting to pervert the course of justice. The charges concern alleged conduct between December 2018 and May 2025 while Cuthbertson was sole director of Professional Wealth Management Pty Ltd and related companies. He allegedly made false, misleading or dishonest representations to existing and prospective investors and sent draft affidavits to two prosecution witnesses. The Office of the Director of Public Prosecutions is prosecuting the case following an ASIC referral. ASIC cancelled the Australian financial services licence of Professional Wealth Management Services Pty Ltd and permanently banned Cuthbertson from financial services in 2023.
