The Australian Securities & Investments Commission (ASIC) has reissued Regulatory Guide 43 on financial reporting and audit relief, updating and streamlining its guidance for entities seeking relief from financial reporting and audit requirements under the Corporations Act 2001. The reissue reflects legislative reforms since the guidance was last updated, consolidates related ASIC material, and simplifies the existing guidance, including withdrawing Regulatory Guide 29 on financial reporting by Australian entities in dual listed company arrangements. Regulatory Guide 43 applies to companies, disclosing entities, registered managed investment schemes, corporate collective investment vehicles and registrable superannuation entities, as well as their directors and auditors. It outlines how ASIC exercises its powers to grant relief from the financial record keeping, financial reporting and audit requirements in Parts 2M.2, 2M.3 and 2M.4 (excluding Division 4) of the Corporations Act, and sets out how to apply for individual relief where an entity cannot rely on existing class relief. The reissue follows public consultation and replaces the guidance issued in 2011.
