Peru's Securities Market Superintendency (SMV) has filed a criminal complaint with the Public Prosecutor’s Office against those responsible in connection with Finniu S.A.C. after the company’s representatives claimed online that the SMV had authorized it to operate as a privately managed fund in Peru. The SMV said the claim is inconsistent with the applicable regulatory framework and could mislead the public. Private investment fund managers are neither supervised by the SMV nor included in any register it administers. Such managers must inform prospective investors that the SMV does not supervise them and that they bear sole responsibility for fund management, disclosures and related services. The SMV advised investors to verify claims concerning regulatory authorization, registration or supervision against its official list of authorized and supervised entities.
