The Financial Superintendence of Colombia (SFC) imposed an administrative precautionary measure ordering Jovany Andrés Taborda Aristizábal to immediately cease unauthorised collection of money from the public, and to return the funds obtained. The SFC found that at least 31 people delivered COP 1,528,562,000 to Taborda Aristizábal, who allegedly received funds “massively and habitually” without legal authorisation. The activity was promoted via social media, websites and virtual meetings, offering fixed monthly returns of between 2% and 4% and committing to repay principal plus fixed yields without any real delivery of goods or effective provision of services. The model was promoted through various mandate contracts and resource management agreements associated with Fénix Group Consultores S.A.S., Fénix Inversiones y Valores S.A.S. and Fénix Private Investors Corporation. The order was issued through Resolution 0564 of 13 April 2026. The case file was also sent to the Superintendence of Companies for administrative intervention purposes and to the Office of the Attorney General for corresponding criminal investigations.
