The Australian Securities and Investments Commission reported that the District Court of New South Wales sentenced former Equitable Financial Solutions sole director Usman Siddiqui to six years and six months in prison, with a non-parole period of three years and three months. Siddiqui pleaded guilty to two counts of dishonestly using his position as a director after transferring about AUD 1.75 million from company accounts through his personal accounts to overseas accounts between May and October 2019. The transfers occurred while Siddiqui knew the company was in severe financial distress, with clients awaiting about AUD 11.3 million in investment refunds and Australian Financial Complaints Authority determinations exceeding AUD 1 million. Equitable Financial Solutions entered liquidation in November 2019 and was subsequently determined to owe creditors more than AUD 20 million. The judge cited the repeated, intentional dishonesty and the importance of deterrence in white-collar cases. ASIC investigated the matter, which the Commonwealth Director of Public Prosecutions prosecuted.
