The Brazilian Superintendence of Private Insurance (SUSEP) has launched a public consultation on a draft resolution setting rules and criteria for the drafting, structuring, marketing and operation of property and casualty insurance contracts. The proposal would update Circular SUSEP No. 621/2021 to align with Law No. 15.040/2024, which enters into force in December 2025. The draft introduces requirements for contract formation, amendment and renewal, including standardisation of documentation (proposal, contractual documents and policy conditions), Portuguese-language drafting in a durable medium, rules for the use of foreign expressions, and prior availability of conditions to the prospective policyholder. It also provides that, in case of doubt, interpretation should prevail in the manner most favourable to the insured, and requires clear and accessible language across contractual documents and consumer communications. Specific rules are proposed for insurance proposals, distinguishing cases where the insurer makes the proposal and contracting via an insurance ticket is maintained, versus cases where the policyholder submits a proposal supported by a risk assessment questionnaire, with duties set for each party. Comments and suggestions may be submitted within 20 calendar days from publication of the notice via SUSEP’s Public Consultations System.
