The Guernsey Financial Services Commission published a cyber sanctions notice confirming that ZSERVERS and XHOST Internet Solutions LP, alongside six named individuals, have been designated under the United Kingdom’s Cyber (Sanctions) (EU Exit) Regulations 2020 and are now subject to an asset freeze in the Bailiwick of Guernsey. The notice also points firms to the UK consolidated list and reiterates that the UK regime is given local effect under Guernsey’s Sanctions (Implementation of UK Regimes) (Bailiwick of Guernsey) (Brexit) Regulations 2020 made under the Sanctions (Bailiwick of Guernsey) Law, 2018. The designated persons are ZSERVERS (CYB0064), XHOST Internet Solutions LP (CYB0065), Aleksandr Sergeyevich Bolshakov (CYB0066), Aleksandr Igorevich Mishin (CYB0067), Ilya Vladimirovich Sidorov (CYB0068), Dmitry Konstantinovich Bolshakov (CYB0069), Igor Vladimirovich Odintsov (CYB0070) and Vladimir Vladimirovich Ananev (CYB0071). All businesses are required to check for any accounts or other relationships with these (and other) designated persons and to treat as frozen, with immediate effect, any funds, assets or economic resources directly or indirectly owned, held or controlled by them (including jointly held assets and related proceeds such as interest and dividends), as well as assets of persons acting on their behalf or at their direction. Any findings must be reported immediately to the States of Guernsey Policy & Resources Committee, and firms must not make funds or economic resources available to designated persons, entities they own or control, or persons acting on their behalf, unless a permitted derogation applies or a licence has been issued by the Policy & Resources Committee. Where an affected relationship is identified, firms should also inform the Commission and submit a report under Handbook Rule 12.37, as soon as reasonably practicable after meeting statutory reporting requirements to the Policy & Resources Committee. At a minimum, the report must include the name of the relevant customer, beneficial owner, key principal or the linked transaction/asset, and the nature of the business relationship or occasional transaction, including the transaction and/or asset value.
