The Australian Securities and Investments Commission secured Supreme Court of New South Wales orders to wind up Capital Guard AU Pty Ltd on just and equitable grounds. The court appointed McGrathNicol’s Robert Kirman and Jacinta Nielsen as joint and several liquidators to take control of the company, investigate its affairs and seek to preserve and recover assets for creditors and investors. ASIC’s investigation indicates that Capital Guard raised about AUD 17.4 million from around 80 investors, with only a small proportion remaining in known company bank accounts and payment platforms. The regulator’s concerns include the handling of investor funds, the promotion of bond investments that may not have existed as represented, and serious governance and compliance failures. ASIC previously canceled the company’s Australian financial services license after finding serious misconduct, including the promotion of a fake Macquarie Bank bond, false documents provided to its auditor and misleading website statements. Its investigation into Capital Guard and related persons and entities remains ongoing.
