The tribunal determined that the dismissal was unjustified because the bank failed to meet certain procedural requirements under the Collective Bargaining Agreement and required standards of fairness and natural justice. The case arose from a social media post that the bank interpreted as referring to workplace violence and firearms. While recognizing the need for fair disciplinary procedures, the bank maintained that employers must respond to conduct that raises legitimate safety and security concerns and reaffirmed its responsibility to protect employees and the public.
