The Commodity Futures Trading Commission’s Division of Market Oversight issued no-action relief allowing Electron Exchange DCM LLC to continue submitting large trader position and ownership and control reports on behalf of direct participants after introducing futures commission merchant intermediation. The relief effectively applies the reporting approach for exclusively self-cleared contracts to ElectronX’s direct participants, even though its fully collateralized electricity and power futures will be traded by a mix of direct and intermediated participants. ElectronX must submit Part 17 reports on behalf of direct participants and collect the information needed to do so. It remains subject to Regulation 16.00 reporting for futures commission merchant clearing members carrying accounts for non-direct participants, while direct participants retain their Part 18 reporting responsibilities. The relief will expire on the compliance date of any final Commodity Futures Trading Commission action on the matter.
