Ukraine’s National Commission on Securities and Stock Market has secured Ministry of Justice registration for its updated criteria for designating enterprises, institutions and organizations as important to the capital markets and organized commodity markets. The registration advances the commission’s Aug. 13 approval of the criteria and aligns the framework with changes to the government procedure for reserving persons liable for military service. The criteria are intended to identify entities whose operations are important to the stable and continuous functioning of these markets. The revised framework considers ownership links to residents of states posing risks to Ukraine’s economic security, as well as sanctioned participants, beneficial owners or related parties. It also covers systemically important professional market participants, critical infrastructure operators and, if they meet the requirements, self-regulatory organizations. Banks and financial institutions regulated and supervised by the National Bank of Ukraine are excluded. The commission estimates that no more than five new entities could potentially qualify, and meeting an individual criterion will not confer status automatically. Each applicant must document compliance and undergo a comprehensive assessment.
