The National Securities and Stock Market Commission of Ukraine published a column by Chair Oleksii Semeniuk outlining the practical effects of its July accession to the International Organization of Securities Commissions Multilateral Memorandum of Understanding Concerning Consultation and Cooperation and the Exchange of Information. The commission has received its first requests from foreign regulators and begun responding, marking the initial use of the framework for cross-border investigations. The arrangement enables direct cooperation with 131 other capital markets regulators when transactions cross national borders. Authorities may exchange information needed to reconstruct securities and derivatives transactions, including movements through bank and brokerage accounts, account ownership, transaction details and ultimate beneficial ownership. The mechanism is reciprocal, and shared information must remain confidential and be used only for the enforcement or investigative purposes specified in a request. Ukraine's accession followed legislative changes that expanded the commission's authority to obtain transaction and ownership information, collect documents and explanations, share data with foreign counterparts and protect its confidentiality. Semeniuk said the framework adds a layer of investor protection and supports the regulatory trust needed to attract private capital, while noting that its value will depend on effective use in practice.
